Please read these Terms and Conditions carefully before using our website and mobile application services at www.marise.ca which are operated by MARISE, a women's clothing company retailer.

By accessing or using one of our web service you agree to be bound by these terms. If you disagree with any part of the terms then you may not access our services.


1. Purchases

If you wish to purchase any product or service made available through our web services, you may be asked to supply certain information relevant to your Purchase including but not limited to your name, address, email, credit card information, etc.


2. Shared Content

Our web services allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content, the quality and the accuracy of the information you share with our web services.


3. Copyright

Copyright and other relevant intellectual property rights exist on all text, graphics, artwork, MARISE logo relating to the Company’s services and the full content of the website.


4. Intellectual Property Infringement Policy

Nothing in these Terms constitutes a transfer of any Intellectual Property rights from us to you.
We own and retain all proprietary rights to the website, the content, and all associated Intellectual Property rights. You are permitted to use the website only as authorized by us. As a user, you are granted a limited, non-exclusive, revocable, and non-transferable right to use the website and its services to create, display, use, play, and download Content subject to these Terms.
Our Intellectual Property must not be used in connection with a product or service that is not affiliated with us or in any way that brings us in disrepute.

You must not modify the physical or digital copies of any content that you print off or download in any way, and you must not use any illustrations, photographs, video or audio, or any graphics separately from any accompanying text.


5. Limitation of Liability and Warranty

EXCEPT AS OTHERWISE PROVIDED IN THE STANDARD TERMS OF SALE THAT GOVERN THE SAME OF EACH PRODUCT ON THE WEBSITE, THE WEBSITE, THE PRODUCTS OFFERED FOR SALE ON IT AND THE TRANSACTIONS CONDUCTED THROUGH IT ARE PROVIDED BY MARISE ON AN “AS IS” BASIS. MARISE MAKES NO PRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE WEBSITE EXCEPT AS PROVIDED HERE TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAWS. MARISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, DATA ACCURACY, AND SYSTEM INTEGRATION. THE WEBSITE MAY APPEAR INACCURACIES, MISTAKES, OR TYPOGRAPHICAL ERRORS, SO MARISE DOES NOT WARRANT THAT THE CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARISE WILL NOT BE LIABLE FOR ANY DAMAGE OF ANY KIND ARISING FROM THE USE OF THE WEBSITE, INCLUDING BUT NOT LIMITED TO INDIRECTLY INCIDENTAL, PUNITIVE, EXEMPLARY, SPECIAL, OR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARISE'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES (NOT CONSIDERING THE ACTION) SHALL NOT EXCEED IN THE AGGREGATE THE NUMBER OF FEES ACTUALLY PAID BY YOU TO MARISE DURING THE MONTH IMMEDIATELY PRECEDING THE ACT ALLEGEDLY GIVING RISE TO MARISE'S LIABILITY.


6. Order Acceptance

Please note that there may be certain orders that we shall not accept and must cancel. MARISE reserves the right, at sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
Both parties agree that, after the order dispatch, the third-party logistics company is solely responsible for the transportation. During this process, the full ownership of the product(s) belongs to the buyer; all associated liabilities and risks during the transportation shall be borne by the buyer.


7. Transfer of Title

The title to the products in your order will be transferred to you when the products leave our warehouse and are delivered to the carrier for shipment to an address designated by you in the order. All liabilities and risks to the products will also be transferred to you at that time. By placing an order on the website, you authorize MARISE to engage the third-party shipping services on your behalf.


8. Typographical Errors

While MARISE strives to provide accurate product and pricing information, pricing or typographical errors may still occur. MARISE cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, MARISE shall have the right, at our sole discretion, to refuse or cancel any orders placed for the item. In the event that an item is mispriced, MARISE may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.


9. Indemnity

YOU HEREBY INDEMNIFY MARISE AND UNDERTAKE TO KEEP MARISE INDEMNIFIED AGAINST ANY LOSSES, DAMAGES, COSTS, LIABILITIES, AND EXPENSES (INCLUDING BUT NOT LIMITED TO LEGAL EXPENSES AND ANY AMOUNTS PAID BY MARISE TO A THIRD PARTY IN SETTLEMENT OF A CLAIM OR DISPUTE ON THE ADVICE OF MARISE'S LEGAL ADVISERS) INCURRED OR SUFFERED BY MARISE ARISING OUT OF ANY BREACH BY YOU OF ANY PROVISION OF THESE TERMS AND CONDITIONS, OR ARISING OUT OF ANY CLAIM THAT YOU HAVE BREACHED ANY PROVISION OF THESE TERMS AND CONDITIONS.


10. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any agreement which is caused by an event beyond the control of such party, including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, or by an event beyond the control of such party that could not be reasonably foreseen. Any party affected by such event shall forthwith inform the other party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any agreement contained herein.


11. Termination

You agree that we may, at any time and at our sole discretion, with or without cause or any notice to you, terminate your access to the website. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection therewith. If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the website or by sending a communication to any address (email or otherwise) that we have for you in our records.


12. Notice of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the website is assumed to your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on the website. If there are any changes in how we use the website customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on the website 30 days prior to these changes taking place. You are therefore advised to re-read this statement regularly.

These Terms and Conditions shall be governed by Canadian laws.


13. Payment Method

MARISE will accept Master Card, Visa and American Express as methods of payment for purchases made through our secure web site. The person placing the order should always be the cardholder.


14. Secure Transactions

MARISE always use secure connections for all processed transactions. Credit card information are transmitted securely directly to our certified "payment gateway processor" and is no way kept inside our databases for your own security.


15. Privacy

We are committed to maintaining your privacy. We will only collect and process your data in compliance with the law, including legal obligation e.g. fraud, money laundering prevention.

Only Marise qualified employees will have access to it. Where we use third party data processors to assist us, any such third party shall only use your data for the purposes outlined in this Privacy Policy. We reserve the right to revise this Privacy Policy from time to time.
